Terms of service
Last updated 14 October 2026
These terms are an agreement between Chokmah Technologies Pvt Ltd, Bengaluru, Karnataka, India ("we", "us"), which operates Pouncer, and the broker, builder or business that uses Pouncer ("you"). By starting the pilot or using Pouncer, you agree to these terms. They are an electronic record under the Information Technology Act, 2000 and need no physical or digital signature.
The service
Pouncer is a managed service for business use. An AI assistant replies to your property leads on WhatsApp, calls them back in Kannada, Hindi or English, asks qualifying questions, books site visits into your calendar, hands buyers to you on request, and sends you a summary with the call recording. We set up and run the service for you.
You must be a business or a professional acting for your business, and the person accepting these terms must be authorised to bind it. Pouncer is not offered to consumers for personal use.
Free pilot
Your first 14 days are free. No card is needed, and you can cancel at any time during the pilot with no charge. The paid plan starts only if you tell us you want to continue after the pilot.
Fees and payment
- After the pilot, Pouncer costs ₹7,999 a month, on fair use sized to your lead volume during the pilot.
- Builders and high-volume teams can agree custom pricing with us in writing, which then replaces the standard price.
- Fees are billed monthly in advance. Applicable taxes, including GST, are added to the invoice where they apply.
- If an invoice is unpaid 15 days after its due date, we may pause the service after telling you on WhatsApp, and restart it once the invoice is paid.
- We will give you at least 30 days' notice on WhatsApp before any price change applies to you.
Term and cancellation
These terms continue month to month until cancelled. You can cancel at any time by telling us on WhatsApp. The service stops at the end of the month you have paid for, and fees already paid are not refunded. We may end the service with 30 days' notice, or straight away if you materially breach these terms and do not fix the breach within 7 days of our notice.
After the service ends, buyers' data is deleted within 30 days, as set out in our Privacy policy.
Your responsibilities
- Send us only leads you obtained lawfully, from people who enquired about property you are entitled to sell or rent.
- As the Data Fiduciary for your buyers' data, give buyers the notice and obtain the consent the Digital Personal Data Protection Act, 2023 requires, and follow any telecom and marketing rules that apply to you.
- Tell us straight away about any buyer who has asked not to be contacted.
- Keep the property, price and availability details you give us accurate and up to date.
- Do not use the service to send spam, mislead buyers, or contact anyone who did not enquire with you.
AI assistant disclosure
Pouncer uses an AI assistant. Every buyer is told at the start of each WhatsApp conversation and each call that they are speaking with an automated assistant contacting them on your behalf. You agree not to ask us to hide or remove this disclosure. A buyer who asks for a person is handed to you on WhatsApp, and you are responsible for following up.
Call recording
Calls made through the service are recorded and transcribed so that you can review them. Each buyer is told at the start of the call that it is recorded, and a buyer who objects can ask to continue on WhatsApp only. You authorise us to record calls on your behalf on this basis, and you agree to use recordings only to follow up on the enquiry.
Data protection, retention and opt-out
- We process buyers' personal data only on your behalf and on your instructions, as your Data Processor, and only to respond to their enquiry for you.
- We call buyers only between 8am to 9pm. We keep buyers' data, including recordings and transcripts, while you use the service and delete it within 30 days after you stop, or earlier if you ask.
- A buyer who says “stop”, or asks not to be contacted, is not contacted again by Pouncer for you.
- We keep personal data secure with reasonable security practices, and we tell you without delay if a personal data breach affects your buyers.
Our Privacy policy explains this in full and forms part of these terms.
Ownership
You own your leads, buyer data, summaries and recordings. We own Pouncer, its software, scripts and brand. We give you the right to use the service while these terms are in force. We may use anonymised, aggregated information that identifies no person or business to improve the service.
Confidentiality
Each of us keeps the other's non-public business information confidential and uses it only for the service, unless the law requires disclosure.
Third-party services
The service relies on third parties such as WhatsApp, telephone networks and cloud providers. Their outages or policy changes can affect the service, and we are not responsible for them, but we will tell you and work to restore the service as quickly as we can.
No guarantee of outcomes
We provide Pouncer with reasonable skill and care. Pouncer answers and qualifies leads; we do not guarantee that it will produce site visits, bookings or sales, that every call will connect, or that the service will be uninterrupted. To the extent the law allows, we give no other warranties.
Limitation of liability
- Our total liability to you for all claims arising out of or relating to Pouncer or these terms, whether in contract, tort or otherwise, is limited to the fees you paid us for Pouncer in the 12 months before the event giving rise to the claim. During the free pilot, no fees have been paid.
- Neither of us is liable for indirect or consequential loss, or for loss of profits, revenue, business or goodwill.
- Nothing in these terms limits liability that cannot be limited under Indian law, including liability for fraud.
Indemnity
You will compensate us for losses arising from claims by third parties that result from leads you did not obtain lawfully, from your failure to tell us about opt-outs, or from inaccurate property details you gave us.
Events beyond our control
Neither of us is responsible for delays or failures caused by events beyond reasonable control, such as natural disasters, network failures, government action or strikes.
Changes to these terms
We may update these terms. We update the date at the top of this page and tell you on WhatsApp at least 30 days before a material change applies. If you do not agree to the change, you can cancel before it applies.
Governing law and courts
These terms are governed by the laws of India. Subject to that, the courts at Bengaluru, Karnataka have exclusive jurisdiction over any dispute arising out of or relating to these terms or Pouncer. We will first try to resolve any dispute with you in good faith on WhatsApp.
General
If any part of these terms is found unenforceable, the rest stays in force. Not enforcing a right straight away does not waive it. You may not transfer these terms without our written consent. These terms, with any custom pricing agreed in writing and the Privacy policy, are the whole agreement between us about the service.
